Media partner Omnibus – new rules for discounts

In January 2023, regulations implementing the Omnibus Directive came into force in Poland, significantly changing the way discounts must be communicated.

According to the new regulations, traders announcing a discount are obliged to include, in addition to the current price, information on the lowest price for a good or service that applied during the 30-day period prior to the introduction of the discount. However, the practical application of the above regulation raises a number of serious legal questions.

The implementation of the new regulations by individual entities is being closely monitored by the President of the Competition and Consumer Protection Office and the Trade Inspection authorities.

The President of the Competition and Consumer Protection Office has reported that several dozen traders were requested to provide information on discounts only a dozen or so days after the introduction of the new regulations.

The practice to date and the actions of the authorities have already brought to light several major problems for traders.

We therefore invite you to a meeting where we will discuss the most common problems and doubts related to the application of the new regulations.

The event aims to answer a number of key questions, including:

  • How to determine the lowest price from the 30-day period before a discount is offered (including discussion of practical examples)?
  • What should be the benchmark price when different prices are offered via various stores and sales channels?
  • How should the lowest price from the 30-day period before a discount is offered be displayed and described in an online shop, on a label or via a price tag?
  • Is it possible to also refer to a price other than the lowest price from the 30-day period before a discount is offered?
  • What are the rules on price indication in advertising?
  • When is it not necessary to refer to the lowest price from the 30-day period before a discount is offered?
  • What are the penalties for incorrect discount information?
